The Company websites, mobile applications and other digital platforms (collectively, the “Platform(s)”), including the Platform at www.authenticbrands.com and www.authenticnewsroom.com/stories, are operated by Company. As used herein, the term Company (and “we”, “us” and “our”) refers to the Company and its parents, subsidiaries and affiliates, and the terms “you” and “your” refer to any individual user or person that accesses the Platforms or Services (defined below). We recognize the importance of your privacy interests and that you care how information about you is used and disclosed. This Privacy Policy (“Privacy Policy”) is intended to inform you of our information collection, use, disclosure and safeguard practices in connection with information provided or collected through the Platforms and related online offerings, or otherwise processed by us in our business (collectively, the “Service(s)”). We reserve the right to make changes to this Privacy Policy from time to time. The amended Privacy Policy will be posted and made available to you on the Platform and will note the date of posting. Any new version of this Privacy Policy shall take effect and will govern your use of the Platforms upon the date of posting. Your use of, and interaction with, the Platform(s) is governed by the terms of our Terms of Use

What Information Do We Collect and How Do We Use It?

We use your personal information when it is necessary for us to deliver you a service or perform other necessary business functions and activities. We may collect and store certain information from you as detailed below:

-Account Registration. When you register an account with us on any of our Platform(s) you may be asked to provide certain personal information about you during the registration process. When you enter your details in the fields requested, the information provided is used to (i) register your account and grant you access to certain areas of our Platform, (ii) enable Company to provide you with the Services you select, or (iii) to otherwise enforce our Terms of Use and to protect the security or integrity of the Platform, its users and our Company (such as protecting against fraudulent activity). 

-Employment Applicants. When you apply for a job with Company, the information you provide is used to set up and manage your job application profile and to communicate with you in connection with any pending or future employment opportunities with Company. 

-Correspondence. When you correspond with us (e.g., when you contact us with a query about our Platforms or Services) or contact us by any means, your personal information is used to reply to your query or to provide you with services you have requested.

-Browsing our Platforms. We also collect certain information about you automatically when you use our Platform(s), as described below in the section headed Cookies and Other Information That We Collect Automatically, below. We may collect information about your location to the extent that we provide any location services (and to the extent allowed by your device and your mobile application settings), as described in the section headed Location Services below.

-Third Party Interactions.  If you choose to interact with us via a third party social media platform or other third party service, we may receive the information you have provided through that platform or service, in accordance with the terms and privacy policy of such third party. Any collection, use, and management of personal information by third parties are governed by their respective privacy policies and terms, which we recommend you carefully review and comply with.

-We may use the information we collect from you to:

-Manage your accounts and records;

-Assist with your inquiries and requests;

-Send customer service-related communications, including, without limitation, announcements and administrative messages;

-Identify services or products we think you might be interested in based on your information, such your previous interactions with us through the Platform;

-Send you marketing communications (including, without limitation, e-mails) relating to us, our affiliates, our licensees and other third-party partners that we think may be of interest to you where we have a legitimate basis to do so (e.g., as communicated through this Privacy Policy) and in accordance with your communication preferences (please see the Your Choices section below for further information about how you can control these updates);

Cookies and Other Information That We Automatically Collect

Our servers may automatically collect Platform usage information, including Internet Protocol (“IP”) addresses and browser and domain name information.  Our Platforms also use cookies and similar technologies such as web beacons (also known as “clear GIFS” or “pixel tags”) that allow us to recognize you and customize your experience, and to provide us with information about the way you access our Platform, such as traffic patterns. What is a cookie?

Cookies are text files, containing small amounts of information, which are generated by a website or mobile application when you visit it and are downloaded to your computer or mobile device by the browser. Cookies are used to recognize your computer as you move between pages on a website, or when you return to a website or mobile application you have visited previously and are widely used in order to record user preferences or improve platform functionality. Web beacons, clear GIFS and pixel tags, are small (typically one-pixel) electronic images embedded in an online platform that are not ordinarily visible to platform visitors and may be associated with cookies on a platform user’s hard drive. These technologies are often used to bring together information collected about a particular individual in order to display customized advertisements to users of an online platform based on their browsing behavior and to evaluate the effectiveness of such advertisements.

We, along with our Authorized Partners (as defined in the Sharing Your Information section below), use cookies and related technologies to enhance your online experience and to identify how our Platform is used for purposes of Platform evaluation and optimization. Cookies tell us, for example, without limitation, whether you have visited our Platform before. They can also help ensure the advertisements you see online are more relevant to you and your interests.

Cookies can remain on your computer or mobile device for different periods of time. We use both 'session cookies' and ‘permanent cookies’. Session cookies exist only while your browser is open and are deleted automatically once you close your browser. We use non-essential cookies on the basis of your consent. IP Addresses

We will collect information about your computer or mobile device, including where available your IP address, operating system, log-in times and browser type. We use this information to better understand how visitors use our Platform and for internal reporting purposes.

About Advertising

The Platform may use third parties such as network advertisers and advertisement exchanges to serve you advertisements on third party platforms after you leave our Platform, and we use third party analytics to evaluate and provide us and/or third parties with information about the use of the Platform, the viewing of advertisements and of our content. Network advertisers are third parties that display advertisements, which are based on your visits to the Platforms and other apps and sites you have visited.

Third party tracking technologies are not controlled by us, even if they are associated with our Platforms or our advertisements. Statements regarding our practices do not apply to the methods for collecting information used by these third parties and others or the use of the information that such third parties collect. The relevant third party’s terms of service, privacy policy, permissions, notices and choices should be reviewed regarding their collection, storage and sharing practices. We make no representations regarding the policies or practices of third party advertisers or advertising networks or exchanges or related third parties. 

You have choices in respect of the delivery of advertisements. You can opt-out of receiving certain types of behavioral advertisements by visiting the third party websites described in the section headed How to Control or Delete Cookies, above. We are not responsible for effectiveness of or compliance with any third parties’ opt-out options.

Location Services

Some of the services we provide may be able to use information about your location. For these services, which are typically available on mobile devices or applications, you are provided with the opportunity to provide your consent to the use of location services, which, for example, without limitation, process information deriving from GPS, sensors, beacons or Wi-Fi access points in order to allow you to benefit from a more personalized service. You can turn off location tracking through the settings on your device or the relevant application settings.

Sharing Your Information

We will share limited information about you to authorized service providers we use for marketing services, communicating with you, and otherwise providing and managing the Services as described below (“Authorized Partners”). We disclose personal information to our affiliates and Authorized Partners with your consent or as otherwise described in this Privacy Policy. We do not share information about you with other people or non-affiliated companies except under the following circumstances:

o   We may disclose your personal information to third party providers for the purposes of providing online and other payment services, fraud prevention, obtaining analytics based on your information, and any other services required in order for us to use your information for the purposes specified herein;

 

o   We may disclose your personal information to any law enforcement agency, court, regulator, government authority, securities exchange or other third party when we believe in good faith it is necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights or the rights of any third party; 

 

o   We may disclose your personal information to any third party that purchases, or to which we transfer, all or substantially all of our assets and business. Should such a sale or transfer occur, we will use reasonable efforts to try to ensure that the entity to which we transfer your personal information uses it in a manner that is consistent with this Privacy Policy; and

 

o   We may disclose non-personal information to our Authorized Partners for marketing purposes and is generally shared in an anonymized and aggregated form. Such non-personal information may include, for example, the number of users who visited the Platform during a specific period of time.  

What Happens When I Link To or From Another Digital Platform?

Our Platform may contain links to other websites operated by our affiliates or third parties. Please be advised that the practices described in this Privacy Policy do not apply to information gathered through third party web sites and that we are not responsible for the privacy policies, practices or contents of these other web sites. We encourage you to be aware of when you leave our Platform and to read and comply with the privacy policies of any other digital platform that you visit.

What can you do to Protect Your Information?

We want you to feel confident about using our Platform, and we are committed to protecting the information we collect, but you acknowledge that no method of safeguarding is one hundred percent (100%) secure. As such, where we ask you to choose a password in order to access certain parts of our Platform(s), you are responsible for selecting a secure password, regularly updating that password and keeping that password confidential. You should choose a password which you do not use on any other digital platform, and you should not share it with anyone else. If you choose to access our Platform using a password or web browser that is not secure, and provide us with any personal information, then this is at your own risk.

 Your Choices

You have the right to request access to any personal information that we hold about you in our records, to correct any inaccuracies and to update any out-of-date information. In some circumstances, you have the right to request the erasure of your personal information or a restriction of its use.

You have the right to object to us processing your personal information in some cases. In particular, you can ask us to stop sending you direct marketing communications at any time (however please note that we may continue to send you service-related (i.e., non-marketing) communications, such as, without limitation, e-mail updates in connection with your account on a Platform). You may unsubscribe from e-mail marketing communications from us at any time by e-mailing the address in the section headed Contact Us, below, or clicking on the ‘unsubscribe’ link in any Company marketing e-mails. Please allow up to two weeks for us to process your unsubscribe request; you may still receive emails for us while your request is being processed. If you no longer wish to receive push notifications on your mobile device, please consult your mobile device’s user guide.

 California Privacy Rights

If you are a California resident, you have additional rights in connection with our use of your personal information collected through the Platforms. This notice is Under California law, including the California Consumer Privacy Act (“CCPA”), and Cal. Civ. Code 1798.100, et seq. If you are a California resident, you may request certain data regarding our disclosure, if any, of your personal information to third parties for the third parties’ direct marketing purposes. To make such a request, please send an e-mail message to our e-mail address below with “Request for California Privacy Information” in the subject line. You may make such a request up to two (2) times per 12-month period.  If applicable, we will provide you, by e-mail, a list of the categories of personal information disclosed to third parties for their direct marketing purposes during the immediately preceding 12-month period, along with the third parties’ names and addresses. Please note that for purposes of this section, “personal information” has the meaning given to it by the CCPA but does not include certain de-identified or aggregated information, or certain other information excluded from the scope of the CCPA.

Access to Your Personal Information

You have the right to request a copy of the personal information we collect about you, the source of the personal information and to whom it was disclosed, which we will provide back to you in electronic form. For your own privacy and security, and as required by law, we will ask you to sufficiently prove your identity before providing you with the requested information. We will only use personal information provided in such a request to verify the request’s identity or authority to make the request.

Deletion of Your Personal Information

You have the right to request that we delete personal information that we process about you, except when no obligation applies, including, for example, if we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.

Do Not “Sell”

You have the right to opt out of the “sale” of your personal information.

We may partner with advertising companies that use cookies, web beacons and other similar tools to collect information about you and your usage of and behavior on the Platform and use that information to deliver targeted advertisements and tailored promotions to you.

We, or our Authorized Partners, may additionally use this information to help better understand how visitors use websites and/or mobile applications across their various devices. This information is stored and used in an aggregated and anonymous format that does not include personally identifiable information, but the sharing of such information between us and our affiliates or Authorized Partners in this manner may be viewed as a “sale” of such information by certain applicable laws. Nevada Privacy Rights

Nevada residents have the right to request that we do not sell your Personal Information at any time in the future. International Users

Our digital operations are conducted, in whole or in part, in the United States. Regardless of where you live, you consent to have your personal data transferred, processed, and stored in the United States, and allow us to use and collect your Personal Information in accordance with this Privacy Policy.

Children

The Platform is not directed at anyone who we know to be under the age of thirteen (13) years, nor do we knowingly collect any personal information from anyone under the age of thirteen (13). If you are under the age of thirteen (13), do not use the Platform and do not submit any personal information to us. If you access the Platform outside of the United States and are below the age of eighteen (18) (or of such age that you are considered a minor in your applicable jurisdiction) you should not use the Platform without authorization from a legal guardian or parent.
